How to protect consumers from advertising pseudo-medicines?

LIGABisnesInformTo improve consumer protection from unfair advertising of medicines, it is necessary to make appropriate changes not to the Law "On Advertising", but to the Law "On Consumer Protection".

This opinion was expressed by the first deputy chairman of the State Consumer Standard of Ukraine Vladislav Khizhnyak.

Amendments to the Law of Ukraine "On Advertising" concerning the advertising of medicines, dietary supplements and medical equipment will not bring the expected result, according to the State Consumer Standard.

"We are confident in the need to protect consumers from unfair information about over-the-counter drugs, biological and nutritional supplements, medical equipment that is credited with "miraculous" properties. To do this, it is necessary to adjust not the law on advertising, which is mainly proposed today, but first of all, to amend the Law of Ukraine "On Consumer Rights Protection," V. Khizhnyak said.

In her opinion, the wrong definition of the problem will only lead to the complication of its solution.

"Changing only the provisions of the legislation on advertising is a wrong way. The issues of solving the problem lie 99% in the plane of consumer protection legislation and only 1% in the law on advertising. Therefore, it was the State Consumer Standard that was the first to take the initiative to make the necessary changes and submitted its proposals to the Cabinet of Ministers of Ukraine," V. Khizhnyak said.

According to her, the State Consumer Standard has received an appropriate instruction to develop a draft law on amendments to the Law of Ukraine "On Consumer Rights Protection".

Realizing that the process of making changes is quite lengthy, the State Consumer Standard is currently establishing cooperation with the National Council for Television and Radio Broadcasting, the Ministry of Health and the Ministry of Internal Affairs.

Recall that due to the large number of recorded cases of false advertising, the Antimonopoly Committee of Ukraine (AMCU) proposed to prohibit advertising of medicines and biologically active additives (dietary supplements) at the legislative level. The Committee decided to officially appeal to the Cabinet of Ministers of Ukraine and the Verkhovna Rada Committee on Health Protection with a proposal to make appropriate amendments to the Law of Ukraine "On Advertising". To develop detailed changes, it was proposed to create a working group of specialists from the AMCU, the Ministry of Economy, the Ministry of Health, the State Consumer Standard and representatives of the pharmaceutical market.
