Pensioner sued money from badovtirateli

Victory. The pensioner achieved a refund for dietary supplements sold to him under the guise of medicines

Last spring, 69-year-old Viktor Ashkenazi spent more than 300 thousand rubles on medicines. After learning that he received dietary supplements for this money, Ashkenazi obtained a refund of most of the amount from the seller. "After that, I began to respect myself more," says Victor.

Medicine. Back in 2006, Viktor Ashkenazi saw an ad in the newspaper about a cure for joint disease. Last spring, he called the specified phone number, and the courier delivered the purchase to him.

A few days later, Victor received a call from the company "MC Ariadna" and offered to purchase a unique program for improving the body at the DNA level.

"I was convinced that this program is absolutely necessary for me and that if I refuse, I will be the last booby," Ashkenazi says. The next day, the courier delivered two bags of drugs to the pensioner, he had to pay 240 thousand rubles for the purchase.

On the same day, they called from Ariadna again and convinced Viktor Ashkenazi to buy more medicines in the amount of 84 thousand rubles. Calls from Ariadne did not stop, the pensioner was offered all new drugs, but he had nothing to buy them for.

Fighting. For a month and a half, Viktor Ashkenazi took the pills he bought, but he did not feel the promised recovery. It turned out that the medicines sold to him turned out to be biologically active food additives. "I realized that I was deceived. I felt insulted and ashamed in front of my late mother, because she left me the money I spent on dietary supplements before she died. That's not why she tried," says Victor.

The pensioner called Ariadne and said that he wanted to return the medicines and get the money back. He was promised a refund if there was another buyer. Time passed, but there was no news from Ariadne.

Then Ashkenazi wrote a letter to the Moscow department of the Federal Antimonopoly Service, where he complained that Ariadna advertised its products as medicines, actually selling dietary supplements.

Acquaintances. Everyone remembers MC Ariadna, this company was already fined in 2007 due to violations of the law on advertising," says Elena Ostrovova, a spokeswoman for the Moscow department of the FAS. But this time it was not possible to initiate a case on the grounds of violation of advertising legislation and an administrative offense case against Ariadna, because Viktor Ashkenazi did not attach the advertisement itself to his appeal. Nevertheless, according to her, Ariadne could not avoid communication with FAS employees.

Victory. On December 24, Ashkenazi began to receive calls from Ariadne's employees and to ask what claims he had. Then Victor talked to Ariadne's lawyer and wrote a statement in which he indicated the cost of the pills he had already taken. On December 26, a courier arrived at Ashkenazi's home and handed over 230 thousand rubles.

"People who knew about my trouble are surprised that I managed to get the money back," says Victor Ashkenazi.

"Ariadne." Igor Larin, head of the control department of Ariadna, says that the company has a letter from Ashkenazi, where he confirms that he has no claims against the company. They refused to talk about their working methods at Ariadne.

Continuation. Viktor Ashkenazi does not even think to stop his struggle, now he is going to get the company to return 50 thousand rubles, which it withheld from the money owed to him allegedly as VAT.

"When returning the goods, the company is obliged to return to the bearer the entire amount paid by him, VAT is not deducted from this money," says Dmitry Lesnyak, a lawyer from the consumer protection Society Public Control.Where to complain if dietary supplements are imposed on you:
